SC/ST(PoA) Gaps – Interventions

1. Not Registering Complaint. Filing Private cases in the jurisdictions court under section 200 CrPC
2. Not filing cases under proper sections. Alteration of sections through court under 216 Cr PC
3. Not arresting accused. Filing cases before the court to warrant to arrest accused directly under 44 Cr PC.
4. Delay in Filing Charge Sheet. Filing cases before concerned magistrate courts under Rule 7(2) PoA Rules and 173(1) Cr PC
5. Not examining all the witnesses during trail. Petition filed under section 202(2) Cr PC, for protest petition. (Reopen of the Cases) If the consent judge did not examining the witnesses.
6. Filing counter/false cases against Dalits. In the most of the cases upper caste people fabricating false cases against Dalits. Petition filed under section 177 of Cr PC and section 3(i) (viii) SC/ST PoA Act.
7. Negligence of Public Prosecutor. Petition filed under section 301(2) of Cr PC to assist PP
8. Willful Negligence of officials. Filing petition under section 166 of IPC and Section 4 of SC/ST Act 1989.
9. Officials must visit the incident place on time. Under rule 6/12 SC/ST (PoA) Act 1989.
